TERMS AND CONDITIONS
1. General Provisions
The company “International Couriers Nowakowscy”, registered in Ireland, provides courier services consisting of collecting shipments from point A and delivering them to point B, making every effort to meet the designated delivery deadline.
The current Terms and Conditions for Transport Services and the applicable price list are available for public viewing on the website: www.icnowakowscy.ie.
For the collection and delivery of entrusted parcels, International Couriers Nowakowscy uses all lawful methods and means and cooperates with various subcontractors, representatives, intermediaries, and carriers, all of whom are deemed to have been pre-approved by the Sender and/or the Ordering Party.
2. Definitions
Shipment – An item accepted for transport under one transport document, collected from one Sender and delivered to one Recipient.
Parcel – A single unit of packaging securing items for the duration of the transport process, prepared in accordance with these Terms and Conditions.
Recipient – A natural person indicated on the transport document as authorized to receive the shipment.
Sender – A natural person indicated on the transport document as authorized to hand over the shipment to the Carrier.
Ordering Party – The Sender or a natural person who orders the service from the company on behalf of the Sender.
Delivery Notice (Aviso) – A notification of an unsuccessful attempt to collect or deliver a shipment.
Damage Report – Documentation describing damage or loss to a shipment. Required for submitting a complaint.
Waybill / Consignment Note – A document confirming acceptance of the service for execution and constituting proof of the transport contract.
3. Exclusions from Transport
The following items are excluded from transport:
Items prohibited under separate legal regulations, including in particular:
narcotic substances,
tobacco products,
alcohol,
prescription medicines,
psychotropic substances,
plants,
human remains or body parts,
items bearing inscriptions or images infringing legally protected rights,
works of art and antiques,
precious stones and precious metals in any form,
currencies, negotiable securities, certificates,
perishable goods.
Items which, due to their dimensions, weight, or other properties, are unsuitable for transport.
Dangerous goods within the meaning of applicable regulations, including in particular flammable, explosive, radioactive, corrosive, or foul-smelling substances, as well as weapons and ammunition (e.g. gas cylinders, car paints, solvents, varnishes, oils, knives, swords).
Any shipments which, due to their nature, may pose a risk to health or life or may damage or destroy other shipments.
In the event of a breach of the above provisions by the Sender, a contractual penalty equal to five times the service fee, but not less than EUR 800, shall be imposed. Payment of the penalty does not deprive International Couriers Nowakowscy of the right to seek additional compensation exceeding this amount under general legal principles.
Prohibited goods will additionally be confiscated and stored in the company’s warehouse in Ireland or Poland for 30 days, with the possibility of collection upon payment of the contractual penalty (EUR 800).
International Couriers Nowakowscy may refuse to perform the service, in particular if:
performance is impossible due to the specified time or place of delivery,
the shipment is improperly secured by the Sender,
there is a justified suspicion that the declared contents do not match the actual contents.
4. Conclusion of the Contract
International Couriers Nowakowscy accepts shipments for transport by collecting them from the Sender or another location agreed between the Sender/Ordering Party and the company.
Proof of concluding a transport services contract is an email confirmation of order acceptance, a waybill, or another document used by International Couriers Nowakowscy to confirm acceptance of the service.
The Sender is obliged to sign the waybill or another document confirming dispatch, which constitutes acceptance of these Terms and Conditions and the service price.
The Sender is responsible for correctly completing the waybill or other order document, which must include:
Sender details: full address, full name, phone number, and legible signature;
Recipient details: full address, full name, and contact phone number;
shipment dimensions and actual weight;
number of parcels;
description of contents (lack of description, incomplete description, or inconsistency with actual contents may result in rejection of a complaint; insurance applies only to shipments with clearly declared contents);
declared value of the shipment;
any other data necessary for proper execution of the service.
5. Conditions for Acceptance of a Shipment
The Sender is responsible for proper preparation of the shipment, including:
selecting packaging of adequate strength considering the type, contents, and weight;
placing internal protective materials as described in the Shipment Preparation section;
proper labeling due to special transport characteristics (e.g. “fragile,” “this side up”);
goods requiring special care (e.g. TVs, laptops, mobile phones, monitors, computers, electronic or audio equipment) will not be eligible for complaints unless packed in original packaging containing only one declared item and marked accordingly.
Glass and all products containing glass shipped in parcels are not insured (e.g. jars, glasses, bottles, lamps, TVs, monitors). Additionally, factory-packed glass placed inside a consolidated parcel with other items is also not insured.
Glass items and other goods requiring special care (including cosmetics and perfumes) are shipped solely at the customer’s responsibility.
All pharmacological and pharmaceutical products must comply with the regulations of the destination country and must be accompanied by a receipt/invoice and documentation specifying composition and purpose.
Insurance applies only to parcels meeting correct packing criteria. Insurance does not cover external packaging. Complaints may concern only damage to contents.
Bags and suitcases are shipped at the Sender’s own risk, especially if not packed in a cardboard box.
International Couriers Nowakowscy reserves the right to inspect shipments at any time, including weight, dimensions, contents, packaging, and declared value.
6. Shipment Damage
If a parcel is delivered damaged or packaging indicates possible damage, a damage report must be completed at delivery in the presence of the courier. Failure to do so voids compensation claims.
7. Scope of Liability
Liability is limited to the lowest of the following amounts:
EUR 200
actual value of damage
actual replacement or repair value of the contents
The company is not liable for delays or damages caused by the Sender, Recipient, force majeure, incorrect addressing, recipient absence, or indirect losses.
8. Complaints
Complaints must be submitted by email to order@icnowakowscy.ie within 7 working days, together with photos and required documentation.
Only the Ordering Party is entitled to submit a complaint.
Late, incomplete, or unauthorized complaints are deemed not submitted.
9. Fees
Payment for services may be made by the Sender, Recipient, or a designated person:
Cash in Ireland (collection or delivery),
Cash upon delivery in Poland,
Bank transfer in Poland or Ireland at dispatch or delivery.
